  1. Purchases

1.1 These are the terms and conditions by which you can purchase devices through our website. The term ‘device’ in these terms and conditions primarily refers to mobile phones and tablets, but may expand to include additional devices over time.

1.2 Please carefully read these terms before proceeding with your purchase, as they outline the details regarding who we are, how we facilitate the sale, how you and we may change or end the contract, what to do if there is a problem and other important information.

  1. About us

2.1 We are Backed Buy Limited, a company registered in England and Wales. Our company registration number is 16585166 and our registered office is located at Backed Buy, 49 Church Street, Preston, England, PR1 3DH.

2.2 You can contact us by calling our customer service team on 01772 300199 or by emailing us at help@backedbuy.com. If we need to contact you, we will use the contact details you provided when creating your Backed Buy account.

  1. Our Contract with you

3.1 We will consider your purchase accepted when we send you an email confirmation, at which point the contract is formed between us.

3.2 If we are unable to accept your purchase for any reason, we will notify you by email. In such cases, we will either refund your payment or provide an alternative product, should you choose to accept it.

3.3 Once your purchase is confirmed, we’ll assign an order number.

3.4 Backed Buy services are limited to the UK and we do not accept orders from outside the UK.

  1. Registration

4.1 To make a purchase, you are required to register and create a Backed Buy account. We will not accept orders from individuals without a valid account. The registration process requires you to provide accurate information, including your name, address, phone number, email address, and a valid UK credit or debit card. You confirm that all information provided during registration (and any notification of change of such information) is true and correct.

4.2 You are fully responsible for protecting the confidentiality of your login details, you may not share these with or transfer them to any third parties. In case of any unauthorised use or breach of security, you must notify us immediately.

4.3 You must have a valid UK credit/debit card accepted on our website and register it with us. Payments will be made using our payment processing partners.  

4.4 By registering for an account, you agree to comply to our platform’s terms and conditions, and we reserve the right to suspend or delete your account at any time.

  1. PURCHASING FROM BACKED BUY

5.1 On our site, you can view available devices for purchase, which include details such as price, model, color, storage, and condition.

5.2 You grant us a non-exclusive, UK-only, irrevocable, royalty-free license to use any information you provide during the purchase process for the duration of the warranty period offered by us.

5.3 Each device listing will include a description of its condition, categorised as follows:

No cosmetic marks or scratches

Fully functional, powers on and operates perfectly

Original box and accessories included and unused

100% battery health with 0 charge cycles

Original software that has not been modified or jail broken

‘Like new’

No visible marks or scratches

Original box and accessories included

Fully functional, powers on and operates perfectly

Original manufacturer parts

Minimum 95% battery health

Original software that has not been modified or jail broken

‘Excellent’

Minimal light cosmetic marks or scratches that are barely noticeable at arms length

Fully functional, powers on and operates perfectly

Original manufacturer parts

Minimum 85% battery health

Original software that has not been modified or jail broken

If the device you receive doesn’t match the condition described on our website, you may be entitled to a refund or replacement.

5.4 When you purchase a phone or tablet through our site, you will be provided with a 12 month warranty directly from us, covering repairs, replacements or refunding the device depending on the situation.

  1. GENERAL RULES

6.1 Once we accept your order, you are obligated to complete the transaction. By placing an order, you confirm that you have the legal right to do so and enter into the agreement.

6.2 If your order is accepted, the contract is binding, and you can only terminate it in limited circumstances set out in law.

6.3 Please refer to paragraph 10 regarding returns and refunds.

6.4 Backed Buy has the right to suspend any account or prevent any transactions if we believe a buyer is engaged in price or market manipulation.

  1. How to make changes

7.1 To make changes to your order, please contact us, and we’ll let you know if it can be done.

  1. PRE-OWNED DEVICE CHECKS

8.1 We perform a series of diagnostic checks on all pre-owned devices to ensure they function properly and are not blacklisted or stolen.
8.2 All devices purchased from us are wiped of all user data and restored to factory settings. 

  1. Delivery

9.1 Delivery costs will be provided before you complete your purchase. We use Royal Mail, along with DHL as courier partners.

9.2 We aim to deliver your device promptly, with next-day delivery available, including Satardays if you complete your transaction before 5pm Monday to Friday and before 11am on Saturday.

9.3 While we will make efforts to address delays caused by events outside our control, we are not liable for such delays. If the delay is substantial, you may opt to cancel your order and receive a refund.

9.4 If no one is available at your address to receive the delivery, you must arrange for re-delivery or collect the item from a local depot.

9.5 The device becomes your responsibility once it is delivered to the address you provided.

9.6 Ownership of the device transfers to you only after full payment is received.

9.7 We may require additional information from you to complete the delivery. If you fail to provide this within a reasonable time, or if you give us incomplete or incorrect information, we may cancel the contract. We will not be responsible for delays if you don’t provide the requested information in a timely manner.

9.8 We reserve the right to suspend the delivery of your device to:

  • deal with technical problems or changes;
  • update the device to reflect changes in relevant laws and regulatory requirements;
  • make changes to the product in response to your requests or as informed by us.

We’ll notify you in advance if we need to suspend the delivery, unless it’s urgent.

  1. RETURNS AND REFUNDS

10.1 You have the right to cancel your order within 14 days of receiving the device. If the device is faulty, we will either repair, replace, or refund the item as per our warranty.

10.2 We will process any refunds without undue delay, and in all cases, within 14 days of receiving the returned device and approving the return.

10.2.1 Returns within 14 days are at the buyer’s expense. We will not accept any responsibility or financial liability for a non-delivered item. For returns after 14 days, the buyer will cover the cost. We will not accept any responsibility or financial liability for a non-delivered item. If the device is faulty, we will refund return postage up to £10 (proof may be required). If no fault is found, the buyer covers return and re-delivery costs upon dispatch. A tracked, fully insured service like Royal Mail Special Delivery is recommended when returning items to us with appropriate insurance for the item’s value.

10.3 The device must be returned in the same condition they were received, complete with accessories and the original IMEI. Damage to the device may affect the refund amount. If a device doesn’t meet the minimum ‘Excellent’ condition for resale due to damage, no refund will be provided, and the buyer will be responsible for the return costs.

  1. Our Warranty

11.1 Upon delivery, and for 12 months for phones and tablets from the delivery date, we warrant that all devices will:

  • match their description;
  • be free from defects in design, materials, and workmanship; or
  • meet the satisfactory quality standards outlined in the Sale of Goods Act 1979

11.2 Subject to paragraph 11.3, if:

You notify us in writing within a reasonable time after discovering that the device does not meet the warranty;

  • We are given a reasonable opportunity to inspect the device; and
  • you return the device to us using the delivery method we provide, we will either repair, replace or issue a full refund, depending on the situation.

11.3 We will not be held responsible for a device failing to meet the warranty in paragraph 11. if:

  • You continue using the device after notifying us as outlined in paragraph 11.1;
  • The defect occurs because you did not follow our instructions regarding the device’s storage, installation, use, maintenance;
  • You modify or repair the device without informing us;
  • Damage caused to removable parts such as battery covers, port/interface covers and lens caps;
  • The device suffers water or liquid damage;
  • You attempt to root or jailbreak the device, or have already done so; or
  • The defect results from wear and tear, intentional damage, negligence, or abnormal working conditions.

11.4. These terms will also apply to any repaired or replacement devices provided by us under paragraph 11

11.5 After addressing a warranty issue, the device will be returned to you via our courier partners free of charge. However, if the device fails to comply with the warranty due to any of the reasons mentioned above, you will be responsible for the return costs.

  1. Termination

12.1 We may, at our discretion, issue a warning or suspend your account if you: 

  • act inconsistently and in breach of these terms;
  • at any time violate or attempt to violate any rights of any other user on the platform; 
  • are involved in any fraudulent activity; or
  • fail to make any payments due to us under these terms.

12.2 On termination, your rights and obligations remain in effect to process any pending orders, but you may no longer access the platform.

  1. Payment

13.1 Payments are only accepted via UK credit/debit cards or PayPal. Full payment is required before dispatch. We may request proof of payment method and proof of identity and address to validate a transaction to prevent fraudulent transactions.

  1. Our Liabilty

14.1 We are responsible for foreseeable loss and damage caused by our failure to comply to these terms, but not for any loss or damage that is not foreseeable.

14.2 We do not exclude or limit liability to you where it would be unlawful to do so;

  • for death or personal injury caused by our negligence or the negligence of our employees or agents;
  • misrepresentation; or
  • for breach of your legal rights in relation to the devices.

15.1 We will use your personal information only in accordance with our Privacy Policy.

  1. Governing Law and Legal Compliance

16.1 This contract is between you and us, and no third parties have rights to enforce it.

16.2 These terms are governed by English law. Legal action related to the devices can be taken in the courts of England and Wales. If you reside in Scotland, you can take legal action in either the Scottish courts or the courts of England and Wales. If you live in Northern Ireland, you can choose to bring legal proceedings in either the Northern Irish courts or the English
